SIMPSON, Justice.

This case should properly have gone to the Court of Appeals as it was within that court's jurisdiction. We have, however, taken jurisdiction and will deliver the opinion.

The appellee, Ozie Bradley, was charged by affidavit in the Circuit Court of Covington County with the offense of obtaining property by means of a bad check. A warrant of arrest was issued pursuant to the affidavit and the appellee was arrested on August 1, 1963. Appellee...
