The appellant, acting in his fiduciary capacity as administrator of the estate of Joseph Baker, deceased, filed suit in the circuit court of Escambia County, Alabama, to recover judgment for damages against defendant (appellee here). The complaint alleged that the defendant operated an automobile against the person of plaintiff's intestate, thereby inflicting injuries which caused his death.
