All of the Plaintiffs in Error, except Allie Z. Holmes, are the children and heirs of L.A. Holmes who died May 26, 1947. Allie Z. Holmes is the surviving spouse of L.A. Holmes.

L.A. Holmes and Allie Z. Holmes, husband and wife, acquired title to a 140 acre farm in Garvin County, and began living on it around 1934. It is stipulated that they owned only 130...
