Thomas F. Maher, a merchant seaman, sued the defendant steamship company under the Jones Act, 46 U.S.C.A. § 688, to recover damages for personal injuries sustained in the course of his employment aboard the S.S. Steel Traveler on December 18, 1952, charging negligence and unseaworthiness of the vessel. After the jury rendered a verdict in plaintiff's favor for $3,500, he moved under Fed.Rules Civ.Proc. Rule 59(a), 28 U.S. C.A. to set aside...
