This appellant was originally prosecuted in the Recorder's Court of the City of Montgomery on a charge of assault and battery in violation of the ordinances of said city.

Appellant was found guilty in the recorder's court, and perfected his appeal to the Circuit Court of Montgomery County. In the circuit court his jury trial resulted in a verdict and judgment of guilty, and hence this appeal...
