The grand jury of the Circuit Court of Clay County, on June 3, 1953, returned an indictment against Jennings Roscoe Bail, charging that he "on the — day of May, 1953, in the said County of Clay, feloniously, wilfully, maliciously, deliberately and unlawfully did slay, kill and murder one Charles Frame * * *". On the following day defendant entered a not guilty...
