GOODWYN, Justice.

This is an appeal from a decree of the circuit court of Etowah County, in equity, condemning an automobile used in transporting prohibited liquors. The bill seeking condemnation was filed by the state, on the relation of the circuit solicitor, against Howard Boyce Eidson, the appellant, pursuant to Code 1940, Tit. 29, § 247 et seq., as amended.

There is no dispute that the automobile was being used for the transportation of intoxicating...
