This is an appeal from a judgment of conviction for the offense of assault with intent to murder. The party assaulted was at the time the Sheriff of Barbour County, Alabama.

At the inception of the trial proceedings the appellant's attorney filed pleas in abatement, motion to quash the indictment, motion to quash venire, and a motion for a continuance.
