MERRILL, Justice.

Plaintiff, Henderson, sued defendant, Jordan, in the Circuit Court of Macon County. The jury's verdict was for plaintiff and, after a motion for a new trial was overruled, defendant appealed to this Court.

The complaint was in five counts, count 1 being for rent from January 1, 1951 to November 30, 1951. Count 2 was for rent from October 15, 1946 to October 15, 1951. Count 3 was for use and occupation of the land from January 1, 1951 to December...
