On December 10, 1947, E.C. McDaniel was struck and killed by an automobile which was being driven by C.C. Mulvihill who is the defendant-in-error in this case. Both persons were residents of Mississippi, the State in which the accident occurred. In December of 1950 Mulvihill moved from Mississippi to Hamilton County, Tennessee.
