On December 10, 1947, E.C. McDaniel was struck and killed by an automobile which was being driven by C.C. Mulvihill who is the defendant-in-error in this case. Both persons were residents of Mississippi, the State in which the accident occurred. In December of 1950 Mulvihill moved from Mississippi to Hamilton County, Tennessee. In June of 1952 the administratrix of McDaniel sought damages from Mulvihill for this killing by suit instituted in the...
