BUCHANAN, Justice.

This appeal is from an order of the Hustings court reversing and declaring null and void an order of the Commissioner suspending the operator's license of the appellee for two months.

This is the second appeal in the case. The first was taken by Willis from an order of the court affirming the action of the Commissioner. Willis v. Commonwealth ex rel. Com'r of Division of Motor Vehicles, 190 Va. 294,
