LIVINGSTON, Justice.

This suit was instituted by resident citizens and taxpayers of the City of Tuscumbia, Alabama, who own property abutting on what is known as "North Commons," and which is within the territorial limits of said city. It is against the city and others, and seeks to enjoin the city and others interested in the enterprise from the construction and maintenance of tennis courts within the limits of "North Commons."
