The basis for this appeal is a judgment of conviction for assault with intent to rape.

In many aspects the evidence is not in dispute.

It appears that at about midnight on January 15, 1949, Miss Evelyn Ingle (the prosecutrix), Bobbie Holt, and the accused left Rainbow Inn in Walker County, Alabama and proceeded in an automobile in the direction of Miss Ingle's home.
