The plaintiff appeals from a judgment, dismissing his complaint in an action to recover damages for the violation of the Communications Act of 1934.1 The complaint was in three counts, of which the judge dismissed the second and third at the conclusion of the plaintiff's evidence, but submitted the first to a jury which brought in a verdict for the defendant.
