The petitioner-veteran brought this action against the respondent-employer for restoration to his former position, pursuant to the provisions of the Selective Training and Service Act of 1940, as amended, 50 U.S. C.A.Appendix § 308. The case was tried by the court, which made findings of fact and stated its conclusions of law thereon in favor of the respondent and gave judgment accordingly.
