This is an appeal from an order of Special Term which directed the parties to proceed to arbitration for a ruling as to responsibility for delay under a construction contract. Appellant by notice of motion and petition had moved for an order restraining an arbitration attempt as to this and other claims. The motion was granted except as to the portion outlined above.
