This is an appeal by Melvin Randall Messer (hereinafter "Appellant") from an order of the Circuit Court of Mingo County denying the Appellant a new trial subsequent to a jury verdict finding the Appellant guilty of two counts of first-degree murder with recommendations of mercy.
