¶ 1 Joshua Howard attempted to shoot his wife in the presence of their children. A jury found Mr. Howard guilty of one count of attempted first degree murder, one count of first degree assault, and one count of unlawful possession of a firearm. Because the same criminal conduct supported the attempted first degree murder and the first degree assault convictions, the trial court merged the convictions.
