STATE v. IBRAHIM

No. 28756-4-III.

269 P.3d 292 (2011)

164 Wash.App. 503

STATE of Washington, Respondent, v. Yasin Ahmed IBRAHIM, Appellant.

Court of Appeals of Washington, Division 3.

October 27, 2011.

Attorney(s) appearing for the Case

Lee Edmond , Edmond Law, PLLC, Seattle, WA, for Appellant.

James Patrick Hagarty , Yakima County Prosecuting Attorney's Off., Yakima, WA, David Brian Trefry , Attorney at Law, Spokane, WA, for Respondent.

SWEENEY, J.

This appeal follows the conviction of a legal alien for violating a former statute that required aliens to register all firearms. Citizens are not required to register their firearms. The defendant here was a permanent legal alien when he was arrested for possession of a firearm. We conclude that the statute violates the defendant's right to equal protection of laws and we therefore reverse the conviction and dismiss the prosecution.
