BECKER, J.

¶ 1 A trial court does not necessarily abuse its discretion by dismissing a criminal case when a subpoenaed trial witness fails to appear at the scheduled time. In this case, the trial had previously been rescheduled when the same witness was absent without a reasonable excuse. The judge refused to delay the trial any longer and granted the defendant's motion to dismiss. We affirm.
