GLICK v. McILWAIN

No. 62522-5-I.

230 P.3d 167 (2009)

154 Wash.App. 729

Peter GLICK, Appellant, v. Carena C. McILWAIN, Respondent.

Court of Appeals of Washington, Division 1.

Publication Ordered March 17, 2010.

Attorney(s) appearing for the Case

Harvey S. Grad, Attorney at Law, Renton, WA, for Appellant.

Carena C. McIlwain, Anderson Fields & Kahan, Seattle, WA, for Respondent.

Irene C. Glick, pro se.

AGID, J.

¶ 1 Carena McIlwain claimed an attorney lien on a former client's papers and funds in her possession and on a judgment. At her request, the trial court "foreclosed" the lien and entered a judgment in her favor. But chapter 60.40 RCW did not authorize the trial court to reduce the lien to an independent judgment, and McIlwain has not identified any other lawful basis supporting the trial court's action. Accordingly, we reverse the judgment.
