Upon the petition of the Commonwealth of Virginia ("Commonwealth"), an appeal is awarded the Commonwealth from an order of the Court of Appeals of Virginia entered on January 25, 2018.
Upon further consideration whereof, the Court is of the opinion that the Court of Appeals erred in ruling that the Circuit Court of Fauquier County did not abuse its discretion in granting Bernard Clark Duse, Jr. ("Duse") pre-trial bail.
