Upon consideration of the record, briefs, and argument of counsel, the Court is of opinion that the circuit court erred in ruling that appellant did not timely file his notice of tort claim under the Virginia Tort Claims Act ("VTCA"), Code §§ 8.01-195.1 through — 195.9, and in dismissing his complaint on such ground.
