Robert Levon Branch ("Branch") pled guilty to one count of rape in violation of Code § 18.2-61 in the Circuit Court of the City of Portsmouth ("trial court"), which the trial court accepted. Subsequently, Branch made a motion to withdraw his guilty plea prior to sentencing, which the trial court denied.
