Guy Anthony Banks, Jr. was convicted of possessing a firearm after having been convicted of a felony, in violation of Code § 18.2-308.2. Before trial, he moved to suppress the gun and the jacket in which it was discovered as the fruits of an unlawful seizure. The circuit court denied the motion. The Court of Appeals, in an unpublished opinion, affirmed, but on a different ground—a ground neither urged by the Commonwealth...
