While fleeing from a police officer, Carlos Deon Fitchett (appellant), a convicted felon, accidentally dropped a handgun that had been concealed underneath the waistband of his pants. The police officer recovered the handgun, and appellant was charged with possession of a firearm by a convicted felon, in violation of Code § 18.2-308.2(A).
