¶ 1 Petitioner Howard Hatch appeals the district court's grant of summary judgment to Defendants Kane County (the County) and the Kane County Board of Adjustment (the Board). In granting summary judgment, the court declined to disturb the Board's decision to deny Mr. Hatch's application for a building permit on the basis that the property on which Mr. Hatch intended to build had been improperly subdivided.
