¶ 1 Plaintiffs (Lenders) sought to foreclose on the Trust Deed associated with a loan made to Eagle Mountain Lots. In the alternative, Lenders asserted fraudulent transfer in an attempt to set aside the transfer — ultimately to Eagle Mountain City — of water rights allegedly encumbered by the Trust Deed.
