McHUGH, Associate Presiding Judge:

¶ 1 The State appeals from the magistrate's pretrial order dismissing with prejudice the refiled information charging defendant Joel F. Pacheco-Ortega with attempted murder with injury and aggravated kidnapping.1 We reverse.
