MEMORANDUM DECISION

ORME, Judge:

Rule 56 of the Utah Rules of Civil Procedure requires summary judgment to be granted if "there is no genuine issue as to any material fact and . . . the moving party is entitled to a judgment as a matter of law." Utah R. Civ. P. 56(c) (emphasis added). We review a grant of summary judgment for correctness, with no particular deference to the trial court's conclusions of law. See
