MEMORANDUM OPINION

W.A. Gillan owned a 3/8 mineral interest in Texas land, and upon his death in Nebraska in 1963, he devised fractional interests to his wife Mae Gillan and to his children from a first marriage. The appellants are the heirs of Mae Gillan ("Mae Gillan heirs")
