Rodolfo Dominguez was convicted by a Fort Bend County jury of capital murder1 in the shooting death of his ex-girlfriend and her new boyfriend. He was sentenced by the trial court to life imprisonment without the possibility of parole. Dominguez filed a motion for new trial, which was denied. Two of the issues raised in his denied motion challenged the trial
