M.T.D. Environmental, L.L.P. sued the City of Midland for breach of a written contract. The City filed a motion for summary judgment, and the trial court granted it. M.T.D. appealed that ruling to this court. Because we held that contractual waivers upon which the trial court relied were void, we reversed and remanded the case to the trial court.
