GIPSON v. STATE

No. PD-0377-13.

428 S.W.3d 107 (2014)

Raimond Kevon GIPSON, Appellant v. The STATE of Texas.

Court of Criminal Appeals of Texas.

April 16, 2014.

Attorney(s) appearing for the Case

Douglas M. Barlow , Beaumont, Susanne Pringle, Texas Fair Defense Project, Austin, TX, for Appellant.

Stacey Goldstein , Lisa C. McMinn , State's Attorney, Austin, TX, for State of Texas.

KELLER, P.J., delivered the opinion of the Court in which MEYERS, PRICE, WOMACK, KEASLER, HERVEY, COCHRAN, and ALCALA, JJ., joined.

On appellant's plea of true, the trial judge revoked appellant's community supervision for failing to pay his fine and various court-assessed fees. The court of appeals reversed on the basis that the State failed to satisfy its burden of showing, under § 21(c),1 that appellant was able to pay.
