OPINION

PRICE, J., delivered the opinion of the opinion for a unanimous Court.

The appellant was convicted of the offense of aggravated sexual assault, for which the jury assessed a sentence of thirty-five years in the penitentiary. The Dallas Court of Appeals reversed his conviction, however, holding that the appellant was egregiously harmed by a jury charge at the guilt phase of trial that failed to require the jury to render a unanimous
