This appeal is on remand from the Texas Court of Criminal Appeals. Marcos Turrubiate, appellant, is appealing his conviction of possession of marijuana. In an opinion dated February 15, 2012, this court reversed appellant's conviction after concluding the trial court erred in denying appellant's pretrial motion to suppress. See Turrubiate v. State, 365 S.W.3d 780
