Gerardo Rico appeals the trial court's summary judgment in favor of Judson Lofts, Ltd. in Rico's common law negligence suit against Judson Lofts, Ltd. for injuries he sustained in a workplace incident. The crux of Rico's argument on appeal is that Judson Lofts, Ltd. was not protected by the exclusive remedy provision of the Texas Workers' Compensation Act.
