This appeal arises from the trial court's granting of S. Stacy Eastland's traditional and no-evidence motion for summary judgment. Because we hold that Stacy failed in his burden to prove that he was entitled to summary judgment as a matter of law and because there was evidence in the record sufficient to defeat the no-evidence motion for summary judgment, we reverse the trial court's judgment and remand the cause...
