Appellant Pedro Covarrubias was injured while working in appellee's, Diamond Shamrock Refining Company, LP ("Diamond Shamrock"), refinery. Covarrubias sued Diamond Shamrock for damages arising from these injuries. The trial court granted Diamond Shamrock's traditional and no evidence motions for summary judgment.
