I. INTRODUCTION

In two issues, Appellant Capital One, National Association (CONA) appeals the trial court's order granting Appellee Carter & Burgess, Inc.'s (C & B) motion to dismiss for failure to file a civil practice and remedies code section 150.002 certificate of merit. We will affirm.
