A jury convicted Brad Lyle Bokemeyer of driving while intoxicated. See TEX. PENAL CODE ANN. § 49.04 (West 2003). The trial court assessed his punishment at 180 days' confinement, probated for one year, and a $1000 fine. On appeal, Bokemeyer contends that the trial court erred in denying his motion for mistrial on the ground that the prosecutor communicated with jurors in violation of article 36.22 of the Texas Code...
