This is an agreed interlocutory appeal pursuant to section 51.014(d) of the Texas Civil Practice and Remedies Code arising out of an insurance coverage case. TEX. CIV. PRAC. & REM.CODE ANN. § 51.014(d) (West 2008). Because we conclude the trial court erred in failing to decide the substantive legal issue presented by the competing summary judgment motions, we reverse and remand for further proceedings...
