PENAL CODE ANN. § 38.11(d)(1) (West Supp. 2010) and the offense of possession of a controlled substance while in a correctional facility (Count II), see TEX. HEALTH & SAFETY CODE ANN. § 481.115(a)-(b) (West 2010). Appellant appealed both convictions...
