DAVID GAULTNEY, Justice.

Late in the evening on Ronald Lee Kuykendall's birthday, two Liberty County Sheriff Department officers spotted him sitting in his truck parked on the side of the highway. The parking lights were on. The officers "turned around to check on the welfare of the occupant and make sure he was okay." One officer approached the truck on the driver's side, and one went to the passenger side.
