Appellant, Thomas J. Hennen, contracted with appellee, Villas By Design, Inc., ("VBD") for the construction of his residence. The second appellee, Jerry McGinty, is the owner and manager of VBD. Appellant, dissatisfied with the quality of the construction, as well as appellees' efforts to correct the problems, filed suit asserting numerous causes of action against several defendants, including appellees.
