Appellant Milton Lewis Barnes entered a plea of guilty before the jury to the offense of aggravated assault. See TEX. PENAL CODE ANN. § 22.02(a), (b)(1) (Vernon Supp. 2010). The jury found that appellant used a deadly weapon in the commission of the offense and assessed punishment at 40 years' imprisonment.
