Appellant, Jose Alonzo, was indicted on one count of murder, a first-degree felony, see TEX. PENAL CODE ANN. § 19.02(b)(1), (c) (Vernon 2003), and one count of possession of a deadly weapon in a penal institution, a third-degree felony. See id. § 46.10(a)(2), (d) (Vernon 2003). A jury convicted Alonzo of the lesser-included offense of manslaughter...
