This is an appeal in a health care liability case. Delores and Bill Petty were the plaintiffs in the trial court below, and Dr. Rudolf Churner, M.D. and Heritage Eye Center were the defendants. After Dr. Churner and Heritage each filed motions to dismiss the Pettys' claims, the trial court granted Dr. Churner's motion but denied Heritage's.
