The trial court found appellant, David James Garcia, guilty of the misdemeanor offense of driving while intoxicated (DWI). See Tex. Penal Code Ann. § 49.04 (Vernon 2003). The trial court sentenced appellant to three days' confinement in the Harris County Jail and assessed an $800 fine for the DWI conviction.
