The City of Dallas (City) sought to condemn a pedestrian easement on part of a tract of land owned by Pacifico Partners, Ltd. (Pacifico). Pacifico counterclaimed for its attorneys' fees and expenses under Texas Property Code section 21.019(b). The trial judge rendered judgment condemning the easement and granted Pacifico's counterclaim. Both parties appeal. Pacifico challenges the legal and factual sufficiency of the evidence...
